What's new? Illegal gains help MS enter another market.
Illegal and unethical activity helped MS build up it's 50 billion. They were not stopped nearly soon enough. No matter what happens to MS in court, the damage that money can do to competition in any market is enormous.

Companies still willing to partner with Microsoft should never forget that Microsoft an unquenchable thirst to do and own everything. MS has demonstrated on numerous occasions that ethics is not an issue. They will use both unethical legal tactics and illegal tactics to get what they want.

Always enter into a partnership with MS with one major assumption:
That the service or product you provide is something that Microsoft WILL eventually decide to provide themselves.

If taking the partnership plunge with MS, the rules below might help you come out with something besides your skin. I am sure there are many others:

NEVER do anything with Microsoft based on anything VERBAL. There is no such thing as a gentleman's agreement with Microsoft. Every agreement should be religously scrutinized for loopholes and then secured ironclad in writing.

Get any promised money UP FRONT if Microsoft wants you to provide a product or service that will cost you money up front. They have plenty of money to accuse you of and come after you for non-performance. Never put yourself in a position of having to go after Microsoft for a promised, but unpaid amount.

Assume that just allowing Microsoft access to your technology secrets is the same as them using those secrets to provide your product or service themselves. Therefore, make sure that your agreement provides compensation to you as if you sold them the secrets.

Be carefull about burning bridges with other companies to secure a deal with MS. You may find yourself stuck on one side with no way across.
