I hardly thing one would be very nuke like.
After all IBM or another mught buy up that one. Linux/Open Source could work around one. However since there has yet to be any proof that there is even one time will tell. Let's say there are some not just one, and it is proven in a court of law. However there is EVERY chance that the court might decide that the use of the IP by Linux/Open Source was at the time in Good Faith and by doing so give LInux/Open Source time to adjust. Work around the IP used. Now that is only IF there is Proven in court and not in the court of public opinion. Who has the money to take on IBM in the end? And after SCO who want's too?

What if in the course of any given trial it is proven that some of their so called IP is invalid? And some valid? Who is willing to take that chance alone?
