Wise advice ...
Software patents are the reality at this point in time in the USA and wise developers will make use of them. Since most software patents are aquired for defensive purposes anyway, it is not to far fetched an idea to expect more than a few companies to adopt GPL type licensing for key software patents. There is plenty of creativity within the free software community and companies like Red Hat and IBM will likely come forth with the resources (they have IP lawyers on staff or contract) to make sure that any idea with promise gets patented. The worst possible approach is that of denial, trying to pretend that software patents don't exist or won't be enforced. That is just as bad as the denial going on on the proprietary side where a number of proprietary developers are lost in the fantasy that free software either is a mirage or is on the verge of collapse. In either case, living in a state of delusion doesn't bode well for one's future.
