... on its own. The US government has to be willing to make a credible threat of WTO action on IP, and then has to be successful in WTO rulings to have an impact.

The subject must also be more broad than software. The Chinese government can counter by discouraging software imports. Instead, the penalty must involve IP transfer. If no company in the world can transfer IP to China in return for getting a contract, the Chinese government would see the disadvantage in a hurry.

Terrible speculation, but negotiating with the Chinese government appears to resemble closely negotiating with a powerful bandit.
