Possible IBM-Trouble
As for my actual understanding, SCO sued them first for contract breaching. SCO announced, it will extend this suit to UNIX-IP related arguments.

1. Contract breach - "Derivative Works"
The contract breach argument from SCO is primary based on "derivative works", which - from the original AT&T contracts - has to be kept secret. And, IBM + Sequent has build Software based on UNIX, and made this Software public.
This must be SCO?s argument - and IBM?s wrongdoing.

2. Contract Breach - UNIX Source-Code
SCO claims also, IBM hat put or placed UNIX-Source-Code directly into the Linux Kernel, which is public available.
If IBM has done so, IBM is guilty regarding the UNIX-Licence, because of the AT&T contract it was not allowed to put UNIX-Code into public.

3. SCO claims not to give up or put UNIX-Code into public
Another argument from SCO is, that - in terms of the GPL - they did not give up their Code or UNIX-IP Rights, which you have to do or special declare.

This SCO-Argument are weakened by SCO themself, because they try to put the GPL void.

As not UNIX-IP related things are for now brought into the court, I am only awaiting their arguments here to judge for myself.

As a contract breach could be the outcome, IBM will not only pay for the damage, but also IBM would have to Stop AIX and the AIX-Related Business. For IBM-Customers with AIX in place (RS/6000) it could also mean trouble - with SCO.
