After all, the code is allready public, in the form of souce code in Linux.

Really, this court case will be very good for Linux. The GPL is very solid and very well written and will survive the challenge, and benifit from having been challenged.

Really, the absolute worst, but still good for Linux, it that IBM is fround guilty of contract violation and pays millions or billion to SCO, and some other large corporations such as Google pay for using the code tainted by IBM contributions. But, then the code will be replaced by the best and the brightest, all eager to get rid of anything related to SCO, and Linux will emerge with a clean bill of health with all of the intelectual property problems resolved.

And, in the end, the GPL will probably be SCOs un-doing. They distributed the code in question under the GPL. The Judge could rule that they had no way of knowing, but that would be a long shot, since they are the experts and would have to also claim stupidity. You do notice that this issue has SCO scared as well and they are atacking the GPL at every chance.
