Let me remind you that the GPL is not the only license available under Open Source (thanks BOFH for the reminder). RedHat's Advanced Server contains Oracle IP and is not GPL'd. This does not hinder Open Source from using licensed IP, only from releasing it as GPL.

So much for the HUGE roadblock. The real question will be, does Open Source NEED to license any MS IP?
