Europe has issued scores of software patents...
... throngs of them. They leap in a steady flood from the EPO, and each is caught and held safe as a valuable asset by the company that owns the idea.

Yes, the software has to be part of a device, not what another poster has called "pure" data processing. But, as Court and administrative precedents have shown, such unpracticality is rare.
The European companies may want to change the law to make it conform to reality, but they too have put in their applications. Can't have US corporations get all the patents.
