According to the dozens of posts you've made here, patents are going to be the weapon of choice MS uses in its efforts to maintain its dominance. You claim to have inside information that is unimpeachable.

Do you now retract that and claim you are full of it, as ususal? Are you now saying your crystal ball is broken and needs to be replaced?

As far as evidence of MS involvement in the newSCO scam? Well, suppose Bill works at The Central Bank. Bill goes to see known robbers Fred and Joe. Two days later Fred and Joe rob the bank. Is there proof Bill was involved here? There is enough evidence to suspect and even get a warrant to search. Is he involved? That will become known after an investigation.

Of course MS is not going to admit to any anti-competitive behavior. Its foolish to claim innocence based on lack of concrete proof before an investigation. Considering their two decade rap sheet of such behavior its tough not to think MS had a hand in it. When crimes occur the police department 'rounds up the usual suspects' when investigating. MS is 'the usual suspect' here.

And please, don't start with the 'innocent until proven guilty' song and dance routine because that is not true. The doctrine is 'presumption of innocence'. That is not the same thing. If you do not see the difference then stop practicing law on ZDNet without a clue.

As far as software patents go, they are not in and of themselves a bad thing. What is bad is how broken the system is here. 99% of software patents fail to meet the novelty and not obvious to someone in the field tests.

If someone could figure out how to fix the system and implement it according to the original purpose of the patent system then go for it. Right now its so badly broken it needs to be suspended until further notice.

If MS did not plan to use patents against OSS then explain why MS is attempting to get so many patents on its XML schema? The obvious reason is to stop Openoffice from being compatible. This is an excellent example of how badly broken the patent system is. What has MS devised that would not be obvious to anyone skilled in XML scripting?

Before you start apologizing for MS at least come up with some issue that is in question. MS motives are, according to you, not in question. You've stood on your soapbox and railed against OSS and proclaimed MS will kill Linux with software patents. Now you argue the opposite. To what end? Merely to see your arguments in print? You change positions like the wind blows. Either you know, as you claim, that MS is going to use patents against OSS or you don't know. Either way you've already shown your bias is what controls your argument, not the presence of any good sense.
