Based on what evidence? Microsoft has itself been attacked with patents many times, but has yet to attack any other company. So Microsoft should be more wary of patents than anyone else. Its recent actions of forming patent 'alliances' is an indication that it has 'caught on' to the game. Blame others (Eolas comes to mind) for Microsoft's recent patent actions.

"They haven't yet and haven't had to yet but that doesn't mean it won't happen."

Yeah, and the sun hasn't risen in the West yet but that doesn't mean it won't happen. A lot of things 'could' happen. Does that mean we have to plan our entire future around what 'might' happen? Isn't that the justification for tightening security in the U.S. - because we 'might' be attacked again? (Yikes, here we go off topic again.)
