at what point did MS become a monopoly?
At the point when they became able to "punish" OEMs for not following the party line and the OEMs felt that they had no choice. In other words when they achieved the ability to control the market. The same was true of IBM which, by the way, never achieved the market share that MS has. Their market share was somewhere in the 70% range and that was enough to cause an antitrust action that lasted 10 years! It caused IBM to change some of the ways they did business. Those changes brought about the market conditions that produced today's PC market.

As for the legal definition...can't Bill afford the best antitrust lawyers on the planet? Did they give him incompetent counsel?
