Emule is free opensource and has no spyware. Kazaa uses Gator.
None of that wicked crap. Gator does have spyware though. Don't remember what kind but know it isn't after your passwords and stuff, but definily logs web urls visited.

Get Emule anyway. Kazaa is slow, and gives poor protection against spammers (Emule has IP Blocker), leecher (Basic limit ratio & remote 1-1 credit system only in Emule; Better in Mods like MorphXT which enforces UL/DL Ratios), fakes (Mostly in Mods though like MorphXT - Fakes.dat and context-menu access to fake-check DB websites), curruption (Emule has AICH, IP Blocker), and the RIAA/MPAA/Law (IP Blocker). PeerGaurdian can be a IP Blocker to as a firewall blocker.

Best of all, the best rare files are on Emule, almost anything can be found.

btw BitTorrent has the best anti-leecher protection. And BitTorrent is still the best for well-selling large DVDs, Appz, and Gamez, but Emule does better on the rest (about eaual with bittorrent on DIVX-d DVDs).

Kazaa just cant compete. And scree ShareBear, Morpheus (multi-network) and Shareaza (multi-network but no adware/spyware). Gnutella2 is inferior to KAD (& Overnet but KAD is better), Which is fully integrated with ED2K on Emule.
