Ineffectual legislation now on TWO continents.
What a shame the US gov has managed to come up with something even flimsier than than the already hopeless European legislation enacted earlier this year. Without a co-ordinated international approach there is no hope of ever beating this menace.

Both pieces of legislation target the wrong people, i.e. the spammers. To have any effect the people facing court and fines should be the companies whose products are being advertised. How likely a legitimate marketing target can I possibly be for a company offering mortgages in North America only when my address ends .co.UK for gawds sake!
Unless there is an existing customer relationship with the company whose product is being advertised (i.e. a recorded financial transaction in the last 6 to 12 months) then all forms of advertising by e-mail, telephone or SMS should be strictly illegal, with (very large) fines going to the company whose product is advertised.
