No and here is why...
Sun (via the complaint to the EU) understands how important interoperability with MS is. MS is now in a position to install much of their patented processes on Sun Solaris based machines, for a fee.

That way when you buy Solaris, a chunck ends up in MS pockets. Assuming this was a recipical agreement (which it was) it also allows MS to build new features/functions on both Windows and Solaris. It's a win/win for both companies...
