It depends
Some companies, such as Suse (Novell) and Redhat offer indemnification against any lawsuit that may be brought against any customers for using their Linux distro. And then there is the fact that people can change the flavor they use and remove and (potentially) 'offending' code and thus no longer be in violation of any alleged (or real) patent or copyright issues...
