Yeah but who cares?

Those people are merely background noise. You have to get over that, and companies that profit from OSS certainly will. The good ones will come to the common sense realization that trademark infringement is something that can be easily avoided with proper planning and that it should not stand in the way of innovation. And that they should save their energy and resources for conflicts that CAN stand in the way of innovation.

Firefox changed its name twice to avoid possible trademark infringements. Now while it's true that it would have been nice to have avoided that pitfall the first two times, the point is that they finally got past it, and that the new name did nothing to hinder its acceptance. People are flocking to it because of what it does, not for what it's called.
