Microsoft is in more danger from Patents
If patent wars start Microsoft loses. Being as big as they are with that much cash they are a target for litigation from every greedy lawyer.

You see all those personal injury lawyers on TV asking for business. Well wait for the comercials from IP lawyers asking for business. You'll see programmers all around the world lining up to sue Microsoft for small change. It'll be like dying in a swarm of killer bees.

Brinksmanship is what we are seeing.
