How is using the law to protect your work (&way it is used) fear?
By the same token Microsoft is afraid.
What nonsense. There is a system, the GPL is specifically crafted to allow copyright holders to protect the way in which their work is used.

Similarily, the patent system will be used by the Open Software world to protect the intellectual property of the open source world.

I maintain that usually you see new features in the Open Source world well before commercial companies get anywhere near these ideas.
Note: this doesn't mean the Open Source world has to do anything as costly as take out a million patents a day.
I'm not going to go further at this point.
