IBM already paid the sofa change to get rights to the patents. It wouldn't have really mattered to them.
But, there is a clean room GPLed implementation of Java (Kaffe?), and they don't license it from Sun, IBM, or whoever, so...
But as some previous poster said, the project may not have enough to license the patents for the 5-10 years they are valid but might have enough to void them throught the PubPat. The ball is in Kodak's court.
