just who IS open source according to you
I dare you.....sue open source. And where would you start? You cant just go after anyone. You would need to go after the person(s) actualy infringing. There is no one entity you can get in front of a judge.

So you would probably go after a large user of open source software. IBM perhaps? I think IBM is setting an example with SCO that will scare a lot of wannabe patent lawsuits away. You do not want to mess with the bigboys.

You are so happy about software patents but just consider this.....Two or three patents cost sun 92 million....Care to calculate the cost of hundreds of overly broad patents out there should they all decide to go after you? Never mind big buisiness like IBM. Lawsuits themselves are becomming big buisiness so there will be companies that have but one product....Lawsuits. The do not want cross liscencing because they do not produce anything requiring a liscence. All they want to do is patent, buy patents and get you in front of a judge to extort money. How long do you think a medium size buisiness can afford this? Even Sun can not afford to have a few more of these lawsuits and settle each of them. They would be out of buisiness very soon.
