It is after all about the consumer.
Joe Average consumer must first install this software and grant permission for it to be used. That has little or nothing to do with the litigants and that is what the judge seen.

One could almost liken it to a personal search engine that allows consumers to see alternative options and I fail to see how having options presented is a bad thing.
