Not appealing, in the formal sense
This is not a case of priority of claim, which could go through a series of court actions, but one of validity. The PTO Director, at his discretion, has given the company 90 days to state a case before he issues his final ruling. We might think of 90 days as "drawn out", but it is nothing compared to the pendency time of initial application (on the order of 24 months) or the tortuous legal appeals route that can take place in a priority battle.

It's hard to dissuade the Office when it has evidence of prior art, even in light of willingness to spend millions of dollars; there's really nothing to spend them on. Although the Soviets had no trouble revising history, in our social system history remains rather stubbornly fixed.
