BUT.. This is different
That last Oops by Novell was about terms of sale. This one is about a non-compete.

If I sell you something and you in turn sell it to a third party I have no rights over what I sold you. The question about the contract was about what exactly got sold and Novell had to back down.

This is about a contract agreement at the time of sale not about what got sold. Contracts between two parties are NOT binding on any third party. So.. Novell had a contract with the Santa Cruz Operation. This is in no way transferable to Calderra (SCO Group). The original SCO had no right to sell that non-compete to SCO group as that makes a contract between SCO and Calderra binding on Novell (a third party).
