Nobody in the US attending a pubic educational facility (including foreign students) pays what it really costs to educate them, whether they pay in-state, out-of-state, or whatever tuition. So we have an investment there. So what if we keep the IP they worked on as grad students--the US taxpayer generated the grant money; none of which was supported by revenue from the foreign student or their family (grants come from tax money, not tuition). How many breakthroughs have been generated by post-graduate students? If anything, they are only part of a team working on a grant, and a small piece of that. How much IP have we patented that was soely generated by a foreign grad student?
You can't seriously think they don't take that knowledge home with them! That's why they came here in the first place for an education; what do we do--empty their brains when they return home? We educate them, and they use what they learn to compete with us--their home country gets benefit from American research, and uses it to compete. You betcha' we have an investment in them and unless they stay here, and care enough to become American Citizens, we not only lose that investment but find it working against us.
