Huh? Anyone can do a patent search...
If they wanted to know the exact nature of the patent it could be looked up easily. However I don't belive that was/is the issue. I believe the issue is that MS will not simply release it as open source and when asked what thier future plans were they answered with an honest "we aren't sure".
