I don't see court cases, I see open source projects doing their homework on patents and finding restrictions. Would they continue work if they know they're violating a patent?

Yes, some software people would. But a company like IBM, which does have a large legal department, would not be pleased to know they're making themselves vulnerable.

Expect the commercially significant projects to restrain themselves while the more anti-Microsoft bunch charges ahead. But without backing, those projects will have all the success of Mozilla or Linux on the desktop. Much noise, small market.
