Litigation is the last resort
Intermec initially declared all its IP to EPC -- and donated nine (I think) of its patents (IOW, no royalties charged).

Intermec has offered cross-licensing and "earlybird" discounts on all its RFID IP to all companies. (And they're not about to make the terms so onerous as to "kill the golden goose.") Other companies hold IP as well and Intermec has either cross-licensed or pays royalties on it.

Litigation is the last resort.
