A couple of points in favor of the suit.
The best point is if AltNet notified 9 companies doing similar things and 7 of them were willing to settle by implicitly or explicitly acknowledging the patent, then the validity of the patent obviously has some confirmation.

But the past part would be AltNet's obtaining a public identification of the fact that the RIAA member companies are trying to avoid selling music online despite the availability of profits.
That demonstration would make the RIAA companies vulnerable. The phrase that comes to mind is collusion in restraint of trade.

I'd like to see the Justice Department getting interested, though they probably are too busy indicting grandmothers and 12 year old honor students to have the time.
