It therefore follows that restriction (anti-promotion) is unconstitutional. As the primary purpose of the DMCA is restriction, the DMCA is therefore unconstitutional. If not repealed first, it will eventually be so found.

Wrong. I can not reduce your income by using it. Copyright limits the first sale of a material to the originator for a fixed period of time. See Adobe v. Softman for the legal decision.
