Are they kidding?
quote
"It is now well established that hyperlinks directing users to Web sites containing infringing material themselves infringe the underlying copyright."
endquote

So does that mean every search engine that returns hits to infringing material is now violating copyright law? Does it mean that Google, by archiving Usenet articles that may contain infringing material, is violating copyright law?

Taking the same thing to the real world, does it mean that the author of the phone book is violating copyright law of they list a business that contains infringing material?

Does that then mean that the television studios that air commercials touting said phone book (or search engines, to get back to the cyber world) is violating copyright law?

I admit that seems a bit far-fetched, but I would not be surprised if the potential were there. Too many people have filed really ridiculous lawsuits demanding compensation from the most unlikely of sources (guy runs into street light, guy dies, family sues city for street light location).
