Something is flawed but it's not his logic

What the OP is describing is the traditional reasons for copyright. What you are describing, while correct in the details, is the relatively recent expansion of traditional copyright - and THAT is what is flawed. In order for the powerful, international media mega-corps to be able to tilt the copyright balance in their favor, we have to pretend that an email saying, "Good grief, George, isn't this company mismanaged?" is a copyrightable work. That's a recent development and it stinks to high heaven. I hope there are more copyright abuses coming to bring attention to that fact.
