It isn't, persay
and what would have to be brought up is that those counties and cities had choices of Unix and Apple, early Linux/ Free and OpenBSD, a host of office suites from Corel and IBM, open source and "foreign" flavors, but their IT people never RESEARCHED the viable choices becasue of the govt/educational pricing schemes already hammered out by federal/state/local procurement buyers, so they were already skimming the price in comparison to what consumers pay for any software product from most vendors, including IBM, Adobe, Oracle and such. Right now, this is sue mode, and it's up to a judge to determine the merits of the class action. Frankly, it sounds like taxes are bringing in enough revenue, so its time for the easiest target suit.
