RE: California looking to 'open source'
There is plenty of choice now and, the post above notwithstanding, OEMs are now free to install other OS's and they will NOT be punished by Microsoft as a result. Major server vendors have been offering Linux as an option to their largest customers ever since the DOJ ruling came down. Desktop vendors have NOT been offering Linux only because there is simply not enough demand in the marketplace to make it cost effective (before anyone flames me for this, let me first say that I am a Linux advocate, as staunch as they come, and I have first hand experience that, until recently, there has been very little demand for Linux desktops). That is now changing, and it is changing rapidly (note HP's recent announcement regarding their new SuSE laptop). It IS NOW a free market for software and California is CURRENTLY CONSIDERING taking advantage of that option.
RE: California suing Microsoft
This suit is not a complaint over CURRENT conditions at all. It is, in fact, a complaint over PAST conditions during the time Microsoft was indeed engaging in abusive monopolistic practices. The federal disposition did make provision for these sorts of suits, and as the article points out, some have already been successful. As time goes on, there will be more of these lawsuits filed before the statute of limitations runs out regarding Microsoft's past illegal activities. Civil remedies address not only current ongoing situations, but also past issues such as in this case.
