Don't be disingenuous....
Sure we can buy licenses. I have at least three pieces of software for which I've purchased licenses, which are nevertheless Open Source. Note: I said Open Source, not GPL. The two are not equivalent statements. Do you wish to correct your badly-intentioned post?

I'd really love to be able to read the real license, but since Microsoft has 404'd it; we're both at best grasping at straws. Still, there must be an escape clause for commercial third-parties and there may be enough leeway for the GPL and BSD to slip through. Moreover, slipping through may not be necessary. The community can always try to invalidate the patent. Patents on schema have never been tried in a court of law.
