it's a Catch-22
OSS companies seem to all be quite confident that OSS will stand up to the litigations (otherwise they'd be potentially throwing out billions of dollars), but it's consumers that are unsure about it.

The catch is this: if the company indemnifies, it could show that they're giving credit to a suit that many in the open source community believe is baseless. However, if the companies DON'T indemnify, they could lose customers who may not be as informed and/or confident about the suit and don't want to take a chance of being heavily invoiced and/or sued further down the line.

It'll all just keep building until the lawsuit is finally settled or a judgment is made.
