Now I know that I can set up my own P2P network if I wanted to and control access to it.

The article talks about, "seeking evidence of criminal copyright infringement" and "suspected of enabling users to traffic illegally in music, films, software and published works." Nowhere is anyone accused and as I stated in my previous post (following yours) the Supreme Court rulled that P2P networks are not liable for illegal activities that go on.

P2P networks cannot be illegal because what they allow is the free sharing of files, not illegal files. Otherwise TCP/IP, IPX/SPX, telnet, http, gopher, ftp, tftp, fxp and all W3C protocols are just as illegal because they allow the same thing: the free swapping of files.

The illegal activity occurs when the swapped files are used in a manner disallowed by law.

These people are not necessarily real pirates, no one spoke of FTP servers (which are not illegal either), innocent civilians also use FTP and P2P to get business done, and yes, I have actually downloaded and used music *without* violating a copyright!
