I would suggest you learn something about email!
SPF (Sender Policy Framework), of which this article is about, deals with mail policies (rules) on MTA's (Mail Transfer Agents). Examples of MTAs are Sendmail, Exim, Postfix, Exchange... The SPF takes place on the server, not the client, as there is POP and IMAP clients (IMAP is what is used for Web based mail, among other applications).

I get the impression from your post that you have never run a mail server for a domain or corporation, such that you do not have any experience filtering mail (say with procmail, which I have used to filter both SPAM and viruses). If you had, maybe you would have some basis for your comments.

The 95% only deals with the client machine and SPAM can be autogenerated via a script and a mail list (it really isn't that hard!). The ruling (or opinion) that you refer to (Courts Finding of Fact: http://www.usdoj.gov/atr/cases/f3800/msjudgex.htm and Conclusion of Law: http://usvms.gpo.gov/ms-conclusions.html) even teh judge knew the difference between clients (PC's) and middleware (MTA's), even dealt with Web based email (so much for the PC sender theory...).
