This anology doesn't make much sense. By this logic, P2P users would need to sue Kazaa because the program allowed them to distribute files they did not have the rights to?

And the fact is, Kazaa already has a "do not drink!" label, in the EULA. Just like the idiot who drank the Drano, or spilled the McDonalds coffee in their lap, if there's a warning message and you suffer because you didn't heed the warning, it's your fault.

If anything, if Kazaa gets shut down, they could sue individual P2P users for violating their EULAs :->
