Uploading vs. Copying
Uploading assumes that the files are going to a server for common access, which is not the case with P2P. P2P programs are simply search engines that allow one to locate a file and transfer a copy to one's own computer.

The download section of ZDNet is just a fancier P2P indexer. When you download a file there, it connects to the home site of said file and retrieves the file for you. However, ZDNet doesn't host most of the files they index. Instead they provide a central location to find a link to those files. (And yes-I do know it is a bit more complicated than that, although the basic idea boils down that concept.)

Now, how is this different than P2P digital copyings, which is what file-sharing is? Instead of commercial sites hosting the files, you have personal users. For example, I have a lot of cool freeware programs on my drive, including some older ones that aren't being hosted anywhere now. If someone does a search for one of those files and finds it on my PC, shouldn't they be able to transfer a copy for their use? I AM talking personal use here, for those who choose to be obtuse..

Notice that whether you are talking music or programs, it is still only making a copy and not a transfer of the original file. The original file is intact and not harmed. It only becomes an issue when one SELLS the copies of the original, which IS a violation of copyright law.

The shame is that there are people out there mortgaging their homes over this because the **AAs don't care whether or not there is actual proof of "copyright infringement" via digital copying. They just want the money.

(Note: I saw a movie the other night on a military base and they showed one of those trailers from the MPAA about "piracy." You know what the reaction was? Laughter! Think about it...)
