And that's the P2P company's problem.. why?
The users AGREED to the terms of the EULA.. why is Kazaa (can't speak for the EULAs of any others..) responsible for what it's users do that is contrary to this license agreement?

It's like using Java to control nuclear facilities (I mention Java specifically, because I recall their EULA having something specifically to this purpose), despite the EULA saying it's not to be used for these purposes.. and then blaming Sun when you have a meltdown!
