You own the plastic and it's contents when you buy the CD. There is no license. Licenses are purely for copying only. As in you are licensed to make X amount of copies. Now a CD could come with a license saying you can make a copy for your computer but I've yet to see that. But the original CD contents you own and you can sell it too.
The key thing to remember is that there are laws saying what you can do with that content. Copyright laws to be specific but they are no differnt that laws that tell you what you can do with guns, cars, houses and such. Those laws don't reduce you the ownership of what you own.
Now is it stealing if you download a song you already own? It would be if it wasn't for fair use but fair use allows for that. This is one of the major reasons they don't sue downloaders. How do you prove they never bought the CD, tape, 8track, LP, or got it off the radio?
