P2P , not server!
There is no upload with P2P, only downloading. So who are these folks who 'put the music out there for others to download'? P2P shares files from your system. As far as music is concerned, in my experience it is like a giant swap meet, where you have to offer so many shares before someone else will let you see there shares.

Everyone, and I do mean EVERYONE, who has ever downloaded a song track from a P2P site KNOWS they are not entitled to it and are stealing. I do agree that I should be able to take my purchased song tracks, either from a ripped CD (that I purchased) or iTMS, and put them on ANY device I own.

The whole 'fair-use' act makes sense ONLY when dealing with a physical medium holding the IP. In the case of CD's, it is OK and fair to loan the CD to a friend. The idea is, you will get the CD back, and the artist will probably sell a new CD to that friend. If you rip a track from a CD and give that track to a friend, you do not have the intention of getting it back. If you rip all the tracks from a CD and give them to a friend, why would that friend by a new CD (unless they are an audiophile and want a better sound experience).
