It will be interesting if it ever goes to court
There have been lawyers in Canada who figure P2P does not infringe on copyrights according to Canadian copyright law but this has not been tested in court. Much like how a Microsoft EULA is figured to be invalid but it to has not been test in court yet.

So what will happen in Canada is lobbying to change copyright law to make file swapping of copyright protected content illegal. I expect this will be a tough sell in canada as a music corporation can donate a grand total of only $1000 to campaigns for Members or Parliment. So it will be tough sell to force a one sided law through.
