Got it backwards in Canada
Making copyright material available is legal but downloading is not. The onus is on the downloader. The example given by the judge is of a photocopier in a library. You could photocopy an entire book but the onus on the copier not the library for providing the books and the copier.

So it's not perfectly legal to download copyright protected material in Canada. It's just damn hard to go after the downloader as you have to prove they had no legal right to download the content. Tough thing to do as you have to prove they don't already own the content in one form or another at some point in time.
