Microsoft reasoned that because too many people are already using the patented technology from Eolas and by forcing Microsoft to pay the license for the technology, it will hurt users because Microsoft is not willing to pay for it and because it will cause widespread inconvenience to web site developers.

So the challenger to the Microsoft patent on the FAT file system will reason that too many people are already using the FAT file system from Microsoft, the Microsoft patent on FAT should also be invalidated. By forcing users of the FAT file system to pay a license for the FAT technology, it will as well hurt users because the users are not willing to pay for it and because it will cause widespread inconvenience to software developers.

It gets even.
