The problem is that's not what they did. It seems everyone was ready to jump on Apple when they responded to Real's crack, and while I agree they shouldn't have even mentioned the DMCA, they did not say they were using it. They said that they were investigating the ramifications of Real's move under the DMCA and other other applicable laws. Personally, I don't think Apple should have mentioned the DMCA at all. I thought it was dumb move when they did, and it has brought them some consumer animosity, but what Apple did was not anything any company wouldn't do. They had a property they wanted to protect for whatever reason and when Real released an unauthorized tool to work around that property, Apple warned that they were going going to investigate whatever legal avenues they had available to them to address the situation. They also let consumers know up front that there was a strong possibility of future firware upgrades defeating what Real was doing. Whether you agree with Apple's lock down on Fairplay or not (personally I don't see why they won't open it up, espcially if it can sell more ipods,) they are being very upfront about it.
