SCO G claims that Novell sold it to SCOp. Novell claims to have documents that clearly show otherwise.

Novell's motion to dismiss was stayed (not denied) because SCO G asked for more time to gather and review documentation not because Novell had no case. The motion may still carry after SCO G gets back in court.

SCO G has no further IP claims against DC. It is now a question of *if* SCO G has a claim of damages for DC not complying in the allotted time. This is still in dispute. The judge has not ruled on that since the liscense does not specify a time limit. SCO G did in their letter.

IBM claims that AIX is a derivative of System V not SCO Unix (Unixware, Open Server). IBM contributed IBM code to Linux and AIX. The code belonged to IBM before they contributed it to AIX and IBM reserved those rights. The SCO G's case is based upon the EULA that allows IBM to use SysV in house. IBM develops and distributes AIX on a developers liscense that does not grant SCO G, Caldera, SCOp, or Novell IP rights to any IBM code it puts in AIX.

It is arguable that RCU, SysV init, ULS, and IPC all came from other sources (such as Sys3, BSD, Netware, IBM, SCOp, Caldera etc.). Besides, AIX code does not equal SCO code and IBM developed based on SysV code it liscensed from AT&T and nothing USL, Novell, SCOp, Caldera or SCO G contributed to Unix is in AIX.
