Constitution doesn't need to be changed
At least not for software patents. The purpose of patents, according to the constitution itself, to promote progress. If it can be shown that software patents *don't* promote the progress of software, then it would be entirely constitutional to restrict/forbid them. Or, theoretically, the Supreme Court could find such patents to be unconstitutional.
