One more time. newSCO claims a contract dispute with IBM. Red Hat brought an action against newSCO, not the other way around. newSCO's action against Novell was a slander of title in a state court but Novell got it bumped up to fed court since newSCO can't prove they own anything and since non-ownership is an affirmative defense against slander of title, newSCO must first prove they own something to bring a slander of title action.
The dispute with DC is because they didn't submit a report of how they are using Unix...hint, DC quit using Unix 7 years ago. That one already got tossed. The action againt Autozone is because SCO claims the Autozone programmers are not smart enough write their own application so they must have based it on something SCO claims to own.
Here is one more clue for you...none of these are copyright infringement actions. Strange, don't you think, that newSCO claims 'millions of lines of copying' yet, despite two court orders to compel discovery, newSCO still has not been able to come up with a single line.
Personally, I think it's time for a Motion for Sanctions against the newSCO legal eagles. Defying two court orders to compel discovery definitely justifies it.
Publicly, newSCO claims these are all copyright actions. I guess they think (or hope) nobody will read the actual pleadings. Boy, were they wrong!!! Well, not completely wrong. You don't seem to have read any of the pleadings. Otherwise you wouldn't publish such misleading stories.
