You will say it and you will once again be wrong
----Aboiut(sic) a year ago I started telling folks that Linux was going to run afoul of the patent laws. Of course all the Linux folks said I was wrong and it would NEVER happen. Well, seems never was not very long in coming was it?----

No, actually, a year ago you were crowing about how the MS/newSCO copyright scam was going to kill OSS. That did not happen. You were wrong. There still have been 0 copyright infringement actions brought. Of course you never let reality stand in the way of your 'bittyland' bubble reality.

Now you are crowing about patents. We are waiting for someone to bring an action there. So far, the only action brought concerning patents are the actions IBM brought against the MS/newSCO scam.

You have a couple of basic problems. You don't know what you are talking about and you don't know what you are talking about.

Whether or not a patent holder has granted a royalty free license for use in GPL'd software does not change the fact the patent holder still holds the patent, same as with copyrights.

If a copyright holder publishes software under the GPL that does not diminish his rights. He is still free to let proprietary software companies use his copyrighted code and charge them royalities. The same is true with patents. A patent holder is completely within his rights to grant a royalty free license to users of GPL software and charge proprietary software companies a royalty for the same patent, or to cross-license with their patents. No rights are diminished by GPL. You have confused the MS (poor) copy of GPL they tried to do with their win CE garbage with the GPL.

For the legally impared, GPL is not public domain. GPL does not require anybody to give up their copyrights or patents (as the MS version does). There are no obstacles to licensing their patent as many ways as their imagination can conceive, within the boundaries of the law. Same with their copyrights.

You really need to stop reading MS/newSCO press releases and read the facts from the people who know what they are talking about. You seem to have many things in common with MS. Not knowing what you are talking about when it comes to GPL is at the top of the list.

Oh, yeah, when I told you a year ago that the MS/newSCO copyright scam would fall flat on it's face. It seems I was right and you were wrong. Can I say "I TOLD YOU SO" yet?

Well, bitty, everything you say here fits you like a glove. You ignored everyone when they told you the MS/newSCO copyright scam would be a hugh flop. You ignored all of it. Does that put you in the same crowd you are flaming here? Seems to.

You, much the same as the other resident MS shill, lovesrocks, seem to have a festering hatred of Linux that is unnatural. Have you considered talking to someone about it. You don't seem to realize how bad you have it. Everyone else does. Much the same as in a marriage with an unfaithful spouse. Everyone knows it before you. Perhaps a bit of counseling will help you face your denial.

You seem to think MS money can buy any law they need. What you seem to forget here is MS is about 1/10 the size of IBM. IBM is banking on Linux to sell lots of hardware and services for them. If MS can buy laws with their assets then IBM should, using your logic, be able to buy them at a ratio of 10:1 over what MS can buy. The difference is that IBM is mature enough to be discrete about it. Chairman billy, on the other hand, is much the same as you...a braggard. He wants everyone to know he bought something.

When MS finds another company, like newSCO, tettering on the verge of bankruptcy and gives them lots of cash to start making rumblings about patents the result will be the same as the MS/newSCO scam. You claim to have been it the software scene for more than 30 years. Of course your ridiculous rants prove you have not. Anyone that has knows the people that really wrote the code that MS patented are still around and they will dig through their old notes and post the proof on Groklaw. In short order the MS patents will be declared null and MS's latest scam will be exposed.

The thing about patents, if you ever bother to go the the USPTO web site, is they have to be new, not something that has been in general use for the last three decades, and they have to be something that is not obvious to a person that works in that field. MS patents will not withstand the scrutiny of either of those tests.

You go right on and root for MS in the patent war. IBM has a portfolio of patents they have been building for several decades. MS will be crushed under the weight of IBM patents. Where did MS get it's "original" ideas? Most of them from IBM and VMS of course. Do you think neither of them bothered to patent any of their original ideas? The rest they got from BSD licensed software, you know, their dubious AD? Isn't that based on LDAP and Kerberos? Wouldn't that make it a derivative? What about netBEUI? Isn't that almost a direct copy of IBM's netBIOS? How about the NTFS? Isn't that an almost exact copy of IBM's HPFS? For over two years I've challenged you to name a single original idea from MS. Up to this point you have not. Can you name one? Huh? Just one, that's all.

Be careful what you wish for, you might just get it. One thing, above all else, is certain. That is you will keep your perfect record of being wrong. Not something everyone wants to be known for but, hey, if it gets you the 15 minutes of fame you crave then go for it. Nobody cares.
